Shoghi Effendi wrote concerning the Guardian of the Bahá'í Faith:
"He cannot override the decision of the majority of his fellow members,..."
Shoghi Effendi, from his spiritual testament, The Dispensation of Bahá'u'lláh:
"The interpretation of the Guardian, functioning within his own sphere, is as authoritative and binding as the enactments of the International House of Justice, whose exclusive right and prerogative is to pronounce upon and deliver the final judgment on such laws and ordinances as Bahá'u'lláh has not expressly revealed. Neither can, nor will ever, infringe upon the sacred and prescribed domain of the other. Neither will seek to curtail the specific and undoubted authority with which both have been divinely invested. Though the Guardian of the Faith has been made the permanent head of so august a body he can never, even temporarily, assume the right of exclusive legislation. He cannot override the decision of the majority of his fellow members, but is bound to insist upon a reconsideration by them of any enactment he conscientiously believes to conflict with the
meaning and to depart from the spirit of Baha’u’llah’s revealed utterances."
What would be a circumstance where this sacred Instruction of `Abdu'l-Bahá for Guardians of the Bahá'í Faith would find application:
"He cannot override the decision of the majority of his fellow members,..."?
I can only speculate, because I am not a Guardian of our Faith. Almighty God always tempers justice with mercy, and His understanding and wisdom is infinite. It seems to me that after the great cleansing of the Earth, that is, the great chastisement of humankind which is approaching on the horizon, a chastisement which will greatly reduce the number of women and men living on Earth, a particularly kindly and merciful Guardian might vote against a harsh piece of legislation designed to curtail or nip in the bud some kind of
wrong activity prevalent before the great cleansing and starting to appear again.
A Majority of members of the legitimate Universal House of Justice functioning at that time might vote in favor of that harsh piece of legislation, and either the Guardian alone, or else the Guardian together with other minority voting members might vote against that legislation. The new Law in question might not "...conflict with the meaning and to depart from the spirit of Baha'u'llah's revealed utterances." such that the Guardian would not "insist upon a reconsideration " of that legislation by his fellow members.
Thus there would become enacted a piece of legislation which a Guardian had actually voted against, because of his kindly nature, he possibly wishing to see a less harsh Law go into effect. Yet the Law is just and necessary and would be God's Will. Immediately after the great chastisement of humankind, it may be necessary for some stern Laws to go into effect in order to prevent a return to the lawlessness and rampant violations of God's Laws which we are observing everywhere on Earth at this time. As time progresses under the Administration of the New World Order, there could possibly be a greater application of mercy to temper such justice, as very few individuals would be violating
the righteous precedents set.
All of the above is, of course, merely my own personal opinion and speculation. One thing I can say with certainty, however, on the authority of the sacred and immutable Will and Testament of `Abdu'l-Bahá, His sacred Instruction:
The instruction: "He cannot override the decision of the majority of his fellow members,..." was an interpretation by Shoghi Effendi of instructions of `Abdu'l-Bahá delineated in His Will and Testament. There most certainly will be a living Guardian casting his vote together with "his fellow members" of a legitimate Universal House of Justice in the Administration of the New World Order of Bahá'u'lláh.
I retain full confidence that the first Guardian’s instruction will fully find its application as
God’s Kingdom becomes established on Earth in complete harmony with the Master’s
Instructions in His Will and Testament.
